論沈家本的法制思想
摘要
沈家本作為近代中國著名法學家、法制改革家和法律思想家，是清末法律改革的重要人物之1，他順應社會發展的歷史潮流，激流勇進，推波助瀾，在近代的法制改革中發揮了極為重要的作用。所以，被法史界譽為“法學泰斗”、“媒介中西法律文化的冰人”、“中國傳統封建法制掘墓人”、“中國法制近現代化奠基人”。沈家本主持清末法律改革，會通中西，融合中西文化；重視人權，主張法律面前人人平等；1法立而天下共守，他主張3權分立；他奠定了中國近代法制的基礎，基本上完成了中國古代法制向近現代法制的轉型，促進了中國法律現代化進程；同時，亦是外來法律資源本土化的過程。
